Early Life of Hermes Gustaf Daniel Giersch
Hermes Gustaf Daniel Girsch was born at 8 am on Wednesday, October 18, 2006, at Cedars-Sinai Medical Center in LA as the first child of Kelly Rutheford and Daniel Giersch. He was born two months after their wedding on August 18, 2006.
Hermes weighed 8 and a half lbs and was 22 inches long when he was born.
Has a Younger Sister
Hermes Gustaf Daniel Giersch has a younger sister named, Helena Grace Rutheford Giersch. She was born three years later on June 8, 2009.
Their parents were already separated when Helena was born. To be precise, Kelly was three months pregnant with Helena when she filed for divorce.
Their Parents’ Relationship
Kelly Rutherford and her partner, Daniel Giersch first met in 2006 and soon started dating. A few months into their relationship, Rutherford became pregnant with Hermes.
The duo walked down the aisle in August 2006. They were together for two years.
Daniel was subtly verbally abusive.

The duo parted ways in 2008 and Rutherford filed for divorce in late December of the same year citing irreconcilable differences.
Custody Battle
The Gossip Girl star, Kelly, and her former partner, German businessman, Daniel, agreed to share their children’s custody. However, things got worse when Daniel was deported from the US in 2012 after his visa got revoked.

During this time, Rutherford had filed for bankruptcy claiming that her legal efforts to keep her kids in the US had cost her over $1.5 million.
In August of the same year, a California court ordered their kids to live with their father in Monaco. Three years later, in 2015, Rutherford received sole custody of their children.
Prior to that, the Scream 3 actress also got a restraining order against Giersch because of accusations that he threatened her nanny and jeopardized her ability to breastfeed.
In July 2015, a California judge ruled against the decision because Kelly was living in New York at the time. The actress then filed a case in a New York court seeking the custody of their kids, but it ruled against her because it didn’t have jurisdiction.
Meanwhile, a Monaco court ordered full custody of their kids to their father in December 2015. In 2018, after a 10 years-long custody battle, Daniel put his Cannes property on the market for a whopping £11.25 million.
